New Delhi: The Law Commission of India is actively considering the issues relating to Bail, on a reference received from the Government of India. The Commission desired to receive further input from police organizations. As desired by Law Commission, Bureau of Police Research and Development (BPR&D) organized a roundtable at its Hqrs here today.
Representative of Central Investigation Agencies, – Central Bureau of Investigation (CBI), National Investigation Agency (NIA), Narcotics Control Bureau (NCB) and different States Police from Andhra Pradesh, Uttarakhand, Bihar, Madhya Pradesh, Telangana, Himachal Pradesh, Haryana, Odisha, Rajasthan, Gujarat, Jharkhand, Tamil Nadu and Delhi participated in the roundtable.
From Law Commission, the Chairman, Dr. Justice B. S. Chauhan and all its three members Mr Justice Ravi R. Tripathi, Prof. S. Sivakumar and Dr. Sanjay Singh attended the roundtable discussion. Consultants and others officials of Law Commission also attended the roundtable.
From BPR&D, Director General Dr. Meeran C. Borwanker, ADG Shri Parvez Hayat, Director (Training), Director (Modernization) and Director (Research) attended.
Various aspects of law of bail were discussed. This included difficulties faced by Police under present arrangements. Criteria for grant of bail and conditions related thereto were recommended to be codified to reduce discretion in the matter. Issues relating to anticipatory bail, use of forged documents to obtain bail, role of victim in bail hearing, bail in matters relating to foreigners, implementation of section 436(A) CrPC etc. were discussed.
