Supreme Court rejects petition of woman claiming to be Jayalalitha’s daughter

A woman claiming to be the biological daughter of former Tamil Nadu Chief Minister Jayalalithaa has filed a written petition seeking a direction to exhume Jayalalitha’s body to conduct the DNA test.

The woman identified as Amrutha and is represented by Lawyer Indira Jaising who has claimed that Amrutha was born in 1980 and also she has some fond memories of Jayalalitha.

The petition is filed under Article 32 of the Constitution and it asks the court to permit the family members of Jayalalitha to cremate her body as per the rites, rituals, and customs of Vaishnava Iyengar-Brahim community to which Jayalalitha and her family members belong.

The petition says “Under Article 21 of the Constitution of India, every citizen is entitled to the right to live with dignity and it includes the right to know…the petitioner wants to know her identity through her natural/biological mother.”

However, Supreme Court refused to take this petition forward but it allowed the woman, the liberty to pursue other remedies in law.

The bench was headed by Justice Madan B. Lokur and Deepak Gupta.

The petition has also sought urgency because these rituals have to be done before the expiry of one year from Jayalalithaa’s death on December 5.
